3A. AI ADVOCATES
3A.1 What AI Advocates Do
Each party may choose an artificial intelligence advocate to help organize that party's account of the dispute into a formal written document, such as a complaint, answer, counterclaim, or reply. Artificial intelligence advocates are software tools. They are not lawyers, they do not form an attorney client relationship with anyone, and their drafts are not legal advice.
3A.2 Responsibility for Drafts
An artificial intelligence advocate works only from the information the party provides. Each party must review every draft before approving it. Once a party approves a draft, that draft is the party's statement, and the party is responsible for its accuracy under Sections 4 and 5. A party must not approve a draft that contains anything the party knows to be untrue.
3A.3 Not a Court Filing
Documents prepared on Start Over Fresh are labeled "Start Over Fresh Advisory Complaint. Not a court filing." or with similar wording. They are not filed with any court, and no User may present them as court documents.
3A.4 How the Judge Panel Uses Drafts
The Judge Panel reviews both the approved draft and the party's original words, and is instructed to decide on the facts and the Evidence rather than on writing quality. The Judge Panel is not told which artificial intelligence advocate prepared a draft.

- The Defendant will be notified by email of the Case
- The Defendant must respond within the response period for the applicable track, measured in Business Days from service: two (2) Business Days for a Standard Case, and five (5) Business Days for a Formal Verdict
- The Defendant may:
- Create an account and respond formally, with the right to appeal
- Respond anonymously, without creating an account, with limited appeal rights
- Decline to respond, in which case the Judge Panel reviews the Plaintiff's submissions alone before issuing an Advisory Verdict
5.2 Response Content

5.4 Prohibited Conduct by Defendant

- Make threats, engage in illegal conduct, or attempt bribery
- Attempt to interfere with the Plaintiff's participation or with a fair process
- Violate any applicable law in responding
- Harass or defame any person, or violate third party rights, in the response
5.5 Default Progression
- If the Defendant does not respond by the applicable response deadline, the matter proceeds to the Judge Panel on the Plaintiff's submissions alone
- The Judge Panel evaluates the Plaintiff's submissions and issues an Advisory Verdict on that record
- The Defendant retains the right to appeal the resulting Advisory Verdict as described in Section 7
5.6 Cost and Fees
- Responding to a Case on Start Over Fresh is free
- An Advisory Verdict does not by itself create a legal obligation to pay
- Operator does not charge separate fees for Defendant Appeals
6. NONBINDING ADVISORY VERDICTS
6.1 Nature of the Verdict
By filing a Case or responding to a Case on Start Over Fresh, each User understands and agrees that:
- The Judge Panel issues an Advisory Verdict, which is an opinion and not a legally binding decision
- An Advisory Verdict is not a court judgment and is not an arbitration award, and it cannot be enforced by a court on its own
- An Advisory Verdict is not enforceable and creates no legal obligation for any party
- No User waives any right to trial, jury trial, discovery, arbitration, or any other legal remedy by using Start Over Fresh
- The parties may voluntarily agree, outside Start Over Fresh and in a separate signed writing, to treat an Advisory Verdict as a settlement between them; Start Over Fresh is not a party to any such agreement
6.2 Scope
Advisory Verdicts cover:
- The dispute between the Plaintiff and the Defendant as submitted in the Case
- Any counterclaims raised in the Case
- Disputes between a User and Operator, including platform disputes and billing disputes, are governed instead by Section 6.6
6.3 Evaluation Procedure
- The Judge Panel consists of three independent artificial intelligence models, drawn from different artificial intelligence providers, selected by Operator and changed from time to time
- Each model independently evaluates the Case materials and issues a determination
- Consensus is reached by majority vote, meaning that two of the three models must agree on the outcome
- Damages, including damages on any counterclaim, are the median of the amounts set by the judges in the majority
- The proceeding is asynchronous, and no oral hearing is required
- Users may not request in person proceedings or depositions
6.4 Effect of the Verdict
- The Advisory Verdict is Start Over Fresh's final advisory opinion on the dispute once any Appeal on Start Over Fresh is decided
- The Advisory Verdict is not legally binding on any party and does not settle the dispute unless the parties separately agree otherwise in writing
- Any party may pursue the dispute in court or in another forum at any time, and Start Over Fresh takes no position in those proceedings
- The Advisory Verdict may be published as described in Section 6.5, whether or not any party accepts it
6.5 Public Verdicts
6.5.1 Consent to Publication. Verdicts are public by design. By filing a Case, a Plaintiff consents to publication of the Advisory Verdict. By responding to a Case, a Defendant consents to publication of the Advisory Verdict. Each User acknowledges that publication is a core feature of Start Over Fresh and a condition of using it.
6.5.2 What Is Published. A public verdict page may include the Case number; the first names of the parties; the dispute category; the amount in dispute and any amount awarded; the outcome and vote tally; a neutral summary of each side's position; and a summary of the Judge Panel's reasoning. Operator will not publish email addresses, telephone numbers, street addresses, account numbers, Evidence files, witness identities, or the full text of any submission.
6.5.3 Default Cases. If a Defendant does not respond and the Case is decided on the Plaintiff's submissions alone, the public verdict will identify the Defendant only as "Defendant (did not respond)" and will not include the Defendant's name. The Plaintiff's first name and the outcome may still be published.
6.5.4 Timing. Verdicts that are not flagged are published no sooner than 24 hours after they are issued. Flagged Verdicts are held for up to 5 days for review. Filing an Appeal pauses publication, or, if the Verdict is already published, the page is marked "Under appeal" until the Appeal is decided.
6.5.5 Nature of Published Content. Every public verdict page states that it is a nonbinding advisory opinion generated by an artificial intelligence panel based solely on the parties' submissions, that it is not a finding of fact or law by any court, and that Start Over Fresh has not independently verified the submissions. Users agree that public Verdicts are opinions and not statements of fact about any person.
6.5.6 Right of Reply. Each party may add one written statement of up to 300 words to the public verdict page within 30 days after publication. Statements are reviewed before posting and must not include personal information, threats, or abusive language.
6.5.7 Search Engines and Permanence. Public Verdicts are indexed by search engines and are intended to remain available indefinitely. Once published, copies may exist in search engine caches, in archives, or on third party sites outside Operator's control. Removal from Start Over Fresh does not guarantee removal elsewhere.
6.5.8 Correction and Removal. A party may request correction or removal of a public verdict by contacting support@startoverfresh.com. Operator will consider requests in the following circumstances: mistaken identity, meaning that the named Defendant is not the person involved; a factual error in the public summary; a court order; a Verdict later overturned on Appeal; a credible safety concern; or personal information that was published by mistake. If the parties settle after publication, either party may ask that the page be marked "Resolved by the parties." Operator decides all requests in its reasonable discretion.
6.5.9 Prohibited Uses of Public Verdicts. Start Over Fresh is not a consumer reporting agency. No one may use public Verdicts, in whole or in part, as a factor in decisions about a person's eligibility for credit, insurance, employment, housing, or any other purpose covered by the Fair Credit Reporting Act or similar laws. Scraping or bulk collection of public Verdicts is prohibited.
6.5.10 Minors and Protected Information. Operator will not publish any Verdict that identifies a minor, and will redact information relating to health, sexual matters, or other sensitive categories before publication.
6.5.11 Privacy Rights. Users in jurisdictions that grant rights to access or delete personal data may submit requests to support@startoverfresh.com. Operator will honor those rights as required by applicable law, which may include removing or further redacting a public verdict.
6.5.12 Responsibility for Submissions. Each party is solely responsible for the truth of what that party submits. Public summaries are based on those submissions. A party who submits false statements about another party may be liable for them, and Operator may remove that party's content and suspend that party's account.
6.6 Disputes with Operator
This Section governs any dispute between a User and Operator, including a dispute about a platform malfunction, billing, or data access.
6.6.1 Notice and Informal Resolution. The User must first send written notice of the dispute to support@startoverfresh.com, describing the dispute and the relief sought. The parties will then attempt in good faith to resolve the dispute informally for thirty (30) days after Operator receives the notice. Neither party will commence arbitration before that period ends.
6.6.2 Arbitration. If the dispute is not resolved within that thirty (30) day period, either party may require that the dispute be resolved by final and binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, before a single arbitrator. The arbitration will be seated in Cook County, Illinois, and the parties may participate remotely.
6.6.3 Small Claims. Either party may instead bring an individual claim in small claims court if the claim qualifies for that court.
6.6.4 Individual Basis. All claims between a User and Operator will proceed only on an individual basis. The User waives any right to bring or to participate in a class, collective, or representative action.
6.6.5 Opt Out. A User may opt out of this arbitration provision by sending written notice to support@startoverfresh.com within thirty (30) days after the User first accepts these Terms. The notice must identify the User and state that the User opts out of arbitration.
6.6.6 Effect. The arbitrator, and not the Judge Panel, decides disputes between a User and Operator. Section 15.2 applies if this arbitration provision is found to be unenforceable.
6.7 Mediation
After both parties have submitted, an artificial intelligence mediator may suggest settlement options. Mediation is:
- Optional. Either party may skip it, and the Case then goes to the Judge Panel
- Confidential. The mediator's suggestions, which party accepted, adjusted, or skipped an option, and any adjustment messages are never shown to the Judge Panel and play no part in the Verdict
- Nonbinding. The mediator is an artificial intelligence tool, not a lawyer, judge, or arbitrator, and does not give legal advice
If both parties accept the same option, the Case closes as "Resolved by agreement" and no Verdict is issued. The agreed terms are a voluntary agreement between the parties. Operator is not a party to that agreement, does not enforce it, and does not move money. Agreed terms appear publicly only if both parties separately opt in.
7. APPEALS PROCESS
7.1 Appeal Rights
- Each party has the right to appeal a Verdict within thirty (30) calendar days of issuance
- An Appeal must be filed by the original filing party, whether Plaintiff or Defendant
- Anonymous Defendants have limited appeal rights, as described in Section 7.4
- An Appeal is decided by a new Judge Panel with a different mix of judges. Where possible, the appeal panel uses different artificial intelligence providers than the original panel. Where the eligible pool does not permit a different set of providers, the appeal panel uses different models from those providers
7.2 Appeal Grounds
Valid grounds for an Appeal include:

APPENDIX A: AI JUDGE METHODOLOGY (INFORMATIONAL)
The Judge Panel uses the following methodology:
- Parallel Evaluation. Three independent artificial intelligence models, drawn from different providers, evaluate each Case without knowledge of the other models' determinations
- Evaluation Criteria. Credibility and consistency of the Evidence; strength of the legal and contractual arguments; applicable law and precedent, where relevant; and the fairness and reasonableness of the claims
- Consensus Voting. Each model votes Plaintiff, Defendant, or Split; a majority vote, meaning two of three, determines the outcome; if the models disagree on damages, the median amount is awarded
- Limitations. Artificial intelligence models may be subject to bias or error; the models do not have access to historical case law; the models cannot predict human judicial outcomes; and Verdicts are not legal opinions
